Foreign men marrying Indonesian women and a $50,000 security guarantee.

The initial draft of a bill on religious marriage law to be put forward to the parliament this year is said by some to contain a clause that would require foreign (Muslim) men wishing to marry Indonesian (Muslim) women to make a deposit of 500 million rupiah (about $50,000) into a sharia bank account as a guarantee, in case they later desert their wives and any resultant children and return to their home countries.

The draft bill, which is called in its full glory Rancangan Undang-undang (RUU) Hukum Materiil Peradilan Agama Bidang Perkawinan, but is sometimes mentioned in the media as RUU Nikah Siri, RUU Peradilan Agama, or RUU Perkawinan, is meant to be a clarification and strengthening of the original Marriage Act of 1974.

The bill, in general terms, says men, foreign or Indonesian, are required to provide monetary support to estranged wives until divorce papers are finalised, and to any children under the age of 21. The $50,000 dollar guarantee is an attempt to prevent foreign men from avoiding these obligations by leaving the country.

Suryadharma AliForeign women wishing to marry Indonesian men will not be required to make similar arrangements, however like men they are expected to get permission from their countries of origin to marry.

Minister of Religion Suryadharma Ali, whose office is responsible for having prepared the draft, says the Department of Religion had heard of a number of cases in Jepara, Central Java, where foreign furniture businessmen had arranged to acquire Indonesian brides, and once their dealings in the town were done deserted their local wives. detiknews

Feby FebiolaAnother actress, the gorgeous Feby Febiola, who is married to somebody called Bruce Deltail from France, says the impression given is that the government is selling Indonesian women, at the right price, and further that not all bules in Indonesia have that sort of money lying around.

Another controversial proposal in the bill includes sanctions of up to six months imprisonment for Muslims carrying out nikah siri informal marriages, which are not later registered with the Department of Religion. This aspect of the bill has excited the most controversy, which has caused Minister of Religion Suryadharma Ali to state that it is only a draft, and will likely be revised before being put to parliament.

    Who’s jumping into conclusions here? I only asked a hypothetical question: “Would you… etc. etc.”

    Who does the word ‘they’ refer too? The bank owners or the lawmakers?

    Does it matter? Do you think they don’t know each other? This is Indonesia, for heaven’s sake. KKN, remember, Korupsi, Kolusi, Nepotism.

    Its like when we are pointing with your index finger while the four fingers pointing to yourself.
    Dont we relize and watch clearcly that our women who married with Indonesiaqn man often facing so many problem…like domestic violance,discrimination, victim of patriarchy culture, sosial sactions….its often considered as normal things … fate, they said.
    So, would be more valuable if we look into our own problem and improve our women position to be equal and respected.. rather than making an controversial law.
    I learnt by experienced..my foreign husband are very nice, attentive and maintain our married seriously… I am very happy you know.
    So please dont ruin the relation inter married with smells of money.

    This RUU is intended for moslem only. And that invites negative interpretation, like hidden islamization agenda. A marriage between moslem and non-moslem is not allowed clearly (someone has to convert, as the consequence) and 500 juta…. did the government assume that only moslem women who got problems in their marriage with foreigners? How about non-moslem women? Do they have no right to be protected too? Seems to me that the government assumed that foreigners tend to choose moslem women, and they worried that those women would follow their husband’s path. Isn’t it also a convertphobia? or foreigner-phobia?

    How about Indonesian men who abuse their wives? Why they do not need to put deposit too for their wives? Instead, this RUU saying that the wives can forgive them if their husbands cannot support them economically; and if the wives become “nusyuz” (cheating, not obey them anymore), they will be free from all of their duties as husbands. Do the non-Indonesia husbands also get this luxury? I don’t think so.

    The reason for choosing the syariah bank, according to MUI as I read from Detik, is because this bank doesn’t apply interests. But the government/MUI didn’t explain further about “bagi hasil” system and how the syariah bank would manage it. Not all moslems is well informed about syariah bank system, and by not explaining it, it seems to me that they try to tell people that they only got their 500 juta back later. That’s so fishy.

    I’m beginning to think it’s more of the latter. Periodical chest-beating to show off power and territorial demarcation. How many times this law proposal did already pop up, only to be buried in the archives of DPR and newspapers, waiting for a couple of lunatics to be revived as a reminder to the world that Indonesia is a reality to take into consideration. Whether or not it would give a supplementary blow to its already tarnished reputation as a backwater after the controversial pornografi law – of which I’m still waiting to see the results, at least here in Bali – doesn’t seem to cross their peanut brains.

    They already stop the debate by saying that the draft is illegal. Amazing, right? From time to time, they still not learn how to dig fresh perspective from public and cannot take the heat. They choose to bury their head rather than trying to manage the public debate as a valuable resource.

    Actually, muslim populations in indonesia are not mentioned in number.it’s only political reason.clifford geertz said only 45%, but his book can’t be distributed.indonesian government had forbbiden.see, when this book was written, Timor Leste was include in indonesia.also, Bali is Hindu, papua west borneo, north sulawesi, batak, toraja are christians in majority.and one again, so far muslim parties don’t winning election yet

    Well…in Thailand if a farang(bule) marries with a Thai girl…and buy a house with the money of the boy, he has to give 51pc of the house to his Thai wife. And divorce cost only USD 20.- She can creat a provocation and divorce..and get the half of the house.

    In Indonesia…if a bule marries a massage lady and deposits USD 50’000.- if she ask for divorce…who will protect the poor bule? But if the bule is also muslim…after depositing USD 200’000.-…maybe he likes to have 4 wifes… 😛

    I think this law is good to protected woman from the foreign man,can be arab can be bule, who just want only have fun and sex from indonesian ladies.
    Just to be honest, why u come to my country now? Some just only for holiday and bussiness.but some just want sex pleasure.and manipulated some ,naïve and poor girl and family,use her until satisfied for some years then leave her.
    So with this law, we just warn for jerk and loser to not come to my country anymore,if just only for prostitution.
    If u falling in love and want marry her, u know how the price. If u serious with her, u will fight urself to get the money.
    50,000 usd, its not the high or low prices. Cuz, u can find this money just for maybe one or some year.its an enough time to get to know each other.
    If some said, if we have a lot of money like that, why we don’t go to another country who have a very sexier ladies than indonesian ladies?

    Wah! this topic on ‘Kawin Campur Bride Prices’ has even been discuss by ordinary folks in the dusuns too. Majority of the ordinary Indonesians don’t agree to the US$50.000 bond that might be required for marriage between a WNA and Wanita WNI. Come what may, instead of the bond, there are ways to lindung a divorced WNI wanita and the kids. I am not a lawyer but I believe that the officials could come up with something that is workable. Let us wait and see what happens next on this R.U.U. which is not the most important thing for the republic to debate in the D.P.R. / M.P.R. Let us put this thing aside for the moment.

    Well, I think the government urgently needs money. If they really want to help the women and children there are other ways. In theory a left behind woman could sue her (ex) husband at a court in his home country. Almost all western countries have laws to ensure that ex partners continue to support eachother after separation or divorce. But this doesn’t work because the Indonesian woman can’t affort lawyer and court fees and there may be a language issue. The government may set up a fund to pay lawyers or translators for women or children who are left behind.

    This is priceless! An expatriate man marries an Indonesian woman and has to pay $50K. Therefore an indonesian woman is worth $50K. Obversely, an expatriate woman marries an Indonesian man. No payment required. Therefore, an indonesian man is worthless. Jolly good of the politicians to clarify the issue!

    All of the rules becoming from Indonesian Goverment i really agree,because sometimes I ever hear and seen my own eyes.When some of my friend (the womans)had married already with her husband from their country and then after she have got kids and they don’t have the same ways in her family.Their took divorced.Her husband was comeback in their country,unfortunately my friends and her kids still living in Indonesia without any support from her husband.Is that your really want it,Indonesian womans?
    I don’t think so! Too much sacrifice for her life and her kids without any support financial from her ex husband.
    That’s way,I really agree with the rules BRIDE PRICE for Indonesian Ladies.Our Goverment just do it for Protect Indonesian Ladies.All the Indonesian Goverment done is positive think and great for Indonesian Ladies.I never the bad thing for that.

    hello everybody! I married my wife on 23 january 2009. We didnt need to deposit any money to get maried. Yeah i forgot to say. I am bule 25 now and she is 34. We met on facebook and liked eachother and love and got married. Because of indonesian laws as long i have visa kitas i can not work, is forbiden from goverment and of course i dont have any income just maybe 1 milion rupiah working as usher. So after one year and 10 months i cant work and money became a problem between me and my wife. We start fighting and getting stressed about the money. And lastnight she told she wants divorce. I dont know if she really ment it. SO INDONESIAN LAWS FORCE US TO THINK ABOUT DIVORCE. So now we i have to deposit 500 milion rupiah to divorce? I have to mention that SHE wants to divorce not me. But i really understand her now i h
